Confidentiality of data

As we are committed to improving the performance of our services, S.C. EUROPEAN FOOD S.A. establishes the technical and organizational measures that ensure the security and confidentiality of personal data, having the obligation to administer, under safe conditions and only for the specified purposes, the personal data provided by users.

At the same time, we reserve the right to periodically update the privacy policy in accordance with the laws in force applicable on the territory of Romania and to make it available to the public free of charge.

We must mention that transmitting information or pictures/videos through our website or e-mail address entails the access of S.C. EUROPEAN FOOD S.A. to this information. In this case, S.C. EUROPEAN FOOD S.A. will not be liable for the payment of any damages that might be claimed by the person who sent them or by any third party.

Disclosure to third parties will be made in accordance with the provisions of this document.

Terms

  • personal data means any information relating to an identified or identifiable natural person (the “data subject”); an identifiable natural person is a person who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that person;
  • processing means any operation or set of operations performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction;Personal data intended to be subject to processing shall be:
    1. Processed in good faith and in accordance with the legal provisions in force;
    2. Collected for specified, explicit and legitimate purposes; the further processing of the data for statistical or other purposes shall not be considered incompatible with the purpose of collection if it is carried out in compliance with the provisions of the law, including those concerning the notification to the supervisory authority;
    3. Adequate, relevant and not excessive in relation to the purpose for which they are collected and subsequently processed;
    4. Accurate and, where appropriate, kept up to date.
  • restriction of processing means the marking of stored personal data with the aim of limiting their processing in the future;
  • profiling means any form of automated processing of personal data consisting of the use of personal data to evaluate certain personal aspects relating to a natural person, in particular to analyze or predict aspects concerning that natural person’s performance at work, economic situation, health, personal preferences, interests, reliability, behavior, location or movements;
  • controller means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data
  • processor means the natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller;
  • recipient means the natural or legal person, public authority, agency or other body to which the personal data are disclosed, whether or not it is a third party.
  • third party means a natural or legal person, public authority, agency or body other than the data subject, the controller, the processor and the persons who, under the direct authority of the controller or the processor, are authorized to process personal data;
  • consent of the data subject means any freely given, specific, informed and unambiguous indication of the data subject’s wishes by which he or she, by a statement or by a clear affirmative action, accepts that personal data relating to him or her be processed;
  • personal data breach means a breach of security leading to the accidental or unlawful destruction, loss, alteration, or unauthorized disclosure of, or access to, personal data transmitted, stored or otherwise processed;
  • representative means a natural or legal person, designated in writing by the controller or the processor, who represents the controller or the processor with regard to their obligations;
  • supervisory authority means an independent public authority established by the Romanian state;
  • international organization means an organization and its subordinate bodies governed by public international law, or any other body which is set up by, or on the basis of, an agreement between two or more countries.
  • anonymous data data which, due to their origin or specific method of processing, cannot be associated with an identified or identifiable person.

What personal data do we collect and from whom?

We process the personal data received from you.

We inform you that we will collect the following personal data:

  • directly:first name and last name, e-mail address, phone number, received from you by phone, by e-mail or through the contact form in the “Contact” section of the website www.europeanfood.ro
  • indirectly/involuntarily:IP address – when you visit our website or when you send a message to our e-mail address or through the contact form in the “Contact” section of the website, your IP address is recorded.

    Operating system, browser, activity on the site– this information may be processed through the use of cookies.

At the same time, we inform you that when you send a message to our e-mail address or through the contact form on the website, you understand that you give your express and unequivocal consent to the use of personal data for the purpose of being contacted and receiving a reply to your message.

The data collected is limited to what is strictly necessary in relation to the purposes for which it is processed, in compliance with the legal measures for data security and confidentiality.

We do not collect or process special categories of personal data revealing racial or ethnic origin, political opinions, religious belief or philosophical convictions, or trade union membership, genetic data, data concerning the sex life or sexual orientation of a natural person.

We must inform you that you are not obliged to send/provide us with any personal data, and failing to provide it does not constitute a requirement necessary for browsing the site.

We bring to your attention that S.C. EUROPEAN FOOD S.A. makes every effort to protect your data, using security methods and technologies, together with confidentiality policies for the data collected.

Nevertheless, we must inform you that the complete security of data transmitted over the internet cannot be guaranteed 100%, there being a risk that the data may be seen and used by unauthorized third parties. We cannot be held responsible for such vulnerabilities of systems that are not under our control. Any transmission of data is done at your own risk.

Purpose of processing

We process personal data for:

  • resolving requests, questions or complaints made by users/visitors by phone, by e-mail or through the contact form in the “Contact” section of the website www.europeanfood.ro

In the event that S.C. EUROPEAN FOOD S.A. intends to further process the personal data for a purpose other than that for which it was collected, it will inform you, prior to processing, about the purpose of that processing and will request your consent.

Transfer of personal data

S.C. EUROPEAN FOOD S.A. processes your personal data on the territory of Romania and does not intend to transfer this personal data to a third country or an international organization.

Recipients of personal data

The recipients of personal data may be, as the case may be:

  • the (data subject) person who provided the personal data or their representatives;
  • the employees of S.C. EUROPEAN FOOD S.A. who have access to your data for the purpose of fulfilling their job duties, strictly within the limits of their professional and job competencies;
  • the companies within the same group of companies as S.C. EUROPEAN FOOD S.A., its/their legal representatives / authorized agents;
  • providers of communications and IT services;
  • central and local public institutions/authorities, courts of law, police, prosecutor’s office, etc.

S.C. EUROPEAN FOOD S.A. does not provide the data collected from users to third parties without the express and prior consent of the users.

Period of processing of personal data

The data is kept and archived throughout the entire period of our activity ( S.C. EUROPEAN FOOD S.A.), until the moment when you or your legal representative exercise the right to object/to erasure, except in the case where we have a legal obligation to continue to store your data in accordance with the GDPR Regulation.

Thus, you have the right to request that we erase your data or certain of your data at any time during the course of our activity.

To exercise your rights, you may submit a written request, signed and dated, to the attention of the Data Protection Officer, at the e-mail address marketing@europeanfood.ro or by post/courier to the following correspondence address: Teatrului street, no. 7, Oradea, Bihor county.

If applicable, S.C. EUROPEAN FOOD S.A. may request that you provide additional information in order to establish the identity of the natural person submitting the request (art. 12, para. (6) of the GDPR Regulation).

We will not charge any fee for the request concerning the exercise of your rights, except in cases where the requests are manifestly unfounded or excessive, in particular because of their repetitive character, in which case we are entitled:

    1. either to charge a reasonable fee taking into account the administrative costs for providing the information or communication or for taking the requested actions;

We will inform you of the fee that would apply before resolving your request.

  1. or to refuse to act on the request.

We undertake to respond to any request that does not adversely affect the rights and freedoms of other data subjects within no more than one month of receiving it, with the exception of cases where the requests are complex or you have made several requests, in which case we will respond within a maximum term of two months.

Any illegal attempt to access, by any method/means, or to request the personal data of another user, may be interpreted as an attempt at fraud and may lead to a criminal investigation against the applicant.

What rights you have

In accordance with the provisions of Regulation (EU) no. 679/2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, hereinafter referred to as the GDPR Regulation, by going through this document we inform you of the rights that you have:

  • The right to be informedThis document regarding the processing of personal data provides the information that you have the right to receive.
  • The right of access to dataYou have the right to request:
    1. that we confirm whether we process your personal data;
    2. that we make available to you a copy of this data (provided that it does not affect the rights and freedoms of others);
    3. that we provide you with other information about your personal data, such as: the data we hold, what we use it for, to whom we communicate/disclose it, whether we transfer it abroad, how we protect it, how long we keep it, what rights you have, how you can make a complaint, from where we obtained your data.
  • The right to rectificationYou may request that we correct or complete your inaccurate or incomplete personal data. We may verify the accuracy of the data before rectifying it.
  • The right to erasure of dataYou may exercise your right to erase your data only in certain situations:
    1. the data is no longer necessary for the purposes for which it was collected;
    2. you have withdrawn your consent (in the case where the processing was based on consent) and there is no other legal ground for the processing;
    3. the data has been processed unlawfully;
    4. you exercise a legal right to object;
    5. we have a legal obligation to erase.

    We are not obliged to comply with the request to erase your personal data in the case where the processing of the data is necessary:

    1. for compliance with a legal obligation;
    2. for the establishment, exercise or defense of a legal claim.
  • The right to restriction of processingYou may request that we restrict the processing of personal data, but only in certain cases where:
    1. you contest the accuracy of the data (see the right to rectification), for a period of time that allows us to verify its accuracy;
    2. the data is no longer necessary for the purposes for which it was collected, but you need it to establish, exercise or defend a legal claim;
    3. you have exercised your right to object to the processing, for the period of time during which it is verified whether its rights override your rights.

    Following the request for restriction, your data may still be used in the following situations:

    1. we have your consent;
    2. to establish, exercise or ensure the defense of a legal claim;
    3. to protect the rights of another natural or legal person.

    The Controller will communicate to the recipients to whom personal data has been legitimately disclosed any modification or erasure or restriction of processing, carried out in accordance with the provisions of the Regulation, except in the case where this proves impossible or involves disproportionate efforts on the part of the Controller. At your request, we can inform you about the respective recipients.

  • The right to data portabilityYou have the right to request that your data be transmitted directly to another data controller, in a structured, commonly used format that can be transmitted automatically. The data can be transmitted where this is technically feasible.
  • The right to objectYou may object to the processing of your personal data on the basis of the Controller’s legitimate interest, in the case where you consider that your fundamental rights, interests and freedoms override this interest.
  • The right not to be subject to a decision based solely on automated processing, including profilingYou may request not to be subject to a decision based solely on automated processing, but only when that decision:
    1. produces legal effects concerning you;
    2. similarly significantly affects you in another way.

    This right does not apply in the case where the decision based solely on automated processing:

    1. is necessary for entering into or performing a contract with you;
    2. is authorized by law and there are adequate safeguards for your rights and freedoms;
    3. is based on your explicit consent.
  • The right to withdraw consentYou have the right to withdraw your consent at any time, in the case where the processing was based on consent, without affecting the lawfulness of the processing carried out on the basis of consent before its withdrawal, and we will act accordingly, except in the case where there is a legal reason or a legitimate interest not to do so.
  • The right to lodge a complaint with the National Supervisory Authority for Personal Data Processing and to bring a judicial remedy, if you consider that the processing of the data infringes the provisions of the Regulation.For any questions regarding the way in which we process your data, please contact us directly in order to resolve this matter.
